What Is a Returning Resident Visa?
The Returning Resident visa allows former UK residents with lapsed ILR to apply to re-enter the UK to settle permanently.
To qualify, you must show:
- You were previously granted Indefinite Leave to Remain.
- You’ve been outside the UK for more than 2 years.
- You intend to make the UK your permanent home again.
- You have strong ties to the UK — such as family, property, or long-term employment history.

What Causes ILR to Lapse?
Under UK immigration rules, ILR automatically lapses if you’ve been outside the UK for more than two continuous years. This applies even if your ILR was originally granted without expiry dates.
Being allowed to re-enter temporarily (e.g. on a visit visa) does not restore your ILR. You must formally apply for a Returning Resident visa if you intend to resume permanent residence.
