🔍 Who Needs Special Permission to Marry?
You will be referred to the Home Office if:
- You are not a British or Irish citizen
- You don’t have Indefinite Leave to Remain (ILR), settled or pre-settled status
- You’re giving notice to marry in England or Wales
This applies even if you hold a UK visitor visa, fiancé visa, or student visa. If the Home Office has concerns about the genuineness of the relationship, they may extend the notice period to 70 days or refuse permission.
📝 The Marriage Notice Referral Process
Here’s how it works:
- Book an appointment at your local register office to give notice
- Bring the required documents (passport, visa, proof of address)
- If you’re subject to immigration control, your notice will be referred to the Home Office
- The Home Office has 28 days (extendable to 70 days) to approve or investigate the application

- Proof of address (dated within 3 months)
- Details of your partner (passport, nationality, address)

⏳ How Long Does It Take?
In most cases, approval is given within 28 days. However, if your case is referred for further checks, it may be extended to 70 days. You cannot marry until the waiting period has passed.
